Action by plaintiff town and one Lothe to have declared invalid an annexation ordinance, adopted by defendant city, which
purported to annex to the city certain lands located in plaintiff town and to enjoin the officers and agents of the city from
enforcing the ordinance. The proposed annexation was attempted under the alternative method designated 'Annexation by referendum' by sec. 66.021(2)(b),
Stats., 1957. A referendum election was conducted among the electors residing in the territory proposed to be annexed, on
September 15, 1959. The next day, the election inspectors, acting as a board of canvassers, filed with the town clerk a written
certification of the results of the election which was not verified by affidavit as required by sec. 66.021(5)(e), Stats.,
1957. This certification disclosed that a total of 38 votes had been cast as follows: 19 votes for annexation and 19 votes
against. A certified statement of the election result was also filed on September 16, 1959 with the clerk of defendant city.
